TERMS OF SERVICE

Plain English summary: MailBraid is a Windows desktop application that runs entirely on your computer. We do not collect your emails, store your data on our servers, or share anything about your communications. These terms govern your use of the software and your licence to use it.

1. WHO WE ARE

MailBraid is a product of Dotjoiner Pty Ltd (ABN 71 691 894 023), a company incorporated in New South Wales, Australia. References to "we", "us", or "our" in these Terms refer to Dotjoiner Pty Ltd. References to "you" or "your" refer to the individual or organisation using MailBraid.

2. WHAT THESE TERMS COVER

These Terms of Service ("Terms") govern your access to and use of the MailBraid desktop application, including any updates, documentation, and related services provided by Dotjoiner Pty Ltd. By downloading, installing, or using MailBraid, you agree to be bound by these Terms.

If you are using MailBraid on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. LICENCE

3.1 Grant of Licence

Subject to these Terms and payment of any applicable fees, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use MailBraid on a single Windows computer that you own or control.

3.2 Trial Licence

We offer a free 30-day trial licence. The trial provides full access to all features. At the end of the trial period, the software will be locked and will not permit further use until a paid licence is purchased. No credit card is required to start a trial.

3.3 Licence Tiers

Paid licences are available on terms set out on our pricing page. Licence keys are machine-bound on first activation and may not be transferred between machines without contacting us at support@mailbraid.com.

3.4 Restrictions

You may not:

  • Copy, modify, distribute, sell, or sublicence the software or your licence key
  • Reverse engineer, decompile, or disassemble the software
  • Use the software to provide a competing service
  • Share your licence key with others
  • Circumvent or attempt to circumvent the licence enforcement mechanisms

4. DATA AND PRIVACY

4.1 Local Processing

MailBraid processes your email data entirely on your local machine. It reads email metadata (subjects, senders, recipients, dates, and short body previews of approximately 500 characters) from your locally installed Microsoft Outlook installation. No email content is transmitted to our servers.

4.2 Data We Do Collect

MailBraid makes two outbound network requests. First, an optional version check to mailbraid.com/version.json, which is user-configurable and can be triggered on startup or manually. This transmits only the current version number of the software. Second, an annual licence renewal check to confirm your subscription currency. Neither request transmits personal data, email data, or usage analytics.

If you request a trial licence, your email address is collected and stored securely for the purpose of issuing and managing your licence. Our software purchase and registration process collects your email address and date of purchase for annual renewal purposes. See our Privacy Policy for full details.

4.3 Your Responsibility

You are responsible for ensuring your use of MailBraid complies with applicable data protection laws and any obligations you have to the owners of the email accounts you index. MailBraid is intended for use with email accounts you own or are authorised to access.

5. PAYMENT AND BILLING

Paid licences are processed through our authorised billing and payment provider, who acts as our Merchant of Record. By purchasing a licence you agree to that provider's terms of service in addition to these Terms. Our billing provider handles all payment processing, invoicing, and applicable tax collection.

All prices are displayed in the currency shown at checkout. GST or other applicable taxes may be added at checkout depending on your location.

6. REFUNDS

Our refund policy is set out separately at mailbraid.com/refund. Because MailBraid offers a full-featured 30-day free trial before any payment is required, we strongly encourage you to evaluate the software during the trial period.

7. INTELLECTUAL PROPERTY

MailBraid, including its code, design, documentation, and all associated materials, is the intellectual property of Dotjoiner Pty Ltd and is protected by Australian and international copyright law. These Terms do not transfer or confer any ownership rights to you.

The MailBraid name, logo, and tagline “From Inbox to Insight” are trademarks of Dotjoiner Pty Ltd.

8. DISCLAIMERS

MailBraid is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the software will be error-free, uninterrupted, or compatible with all configurations of Microsoft Outlook. MailBraid requires Classic Desktop Outlook with a local PST or OST file; it is not compatible with New Outlook or web-based Outlook.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Dotjoiner Pty Ltd's total liability to you for any claim arising from your use of MailBraid shall not exceed the amount you paid for your licence in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law, including guarantees that apply to goods and services supplied to consumers.

10. AUSTRALIAN CONSUMER LAW

If you are a consumer within the meaning of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), you may have rights and remedies that cannot be excluded or limited by these Terms. Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy you may have under the Australian Consumer Law.

11. TERMINATION

Your licence to use MailBraid terminates automatically if you breach these Terms. We may also suspend or terminate licences at our discretion, in which case we will provide a pro-rata refund for any unexpired paid licence term.

On termination, you must cease using the software and delete all copies from your systems. Sections 7, 8, 9, and 13 survive termination.

12. UPDATES

We may update MailBraid from time to time. Updates may add, modify, or remove features. We will not intentionally push an update that degrades core functionality without notice. You are not obligated to install updates, but some may be required to maintain licence validity.

We may update these Terms. If we make material changes, we will update the effective date at the top of this page. Continued use of MailBraid after an update constitutes acceptance of the revised Terms.

13. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or your use of MailBraid will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
